Returns and Refunds Policy

When transacting business with Aykira, the following Returns and Refunds Policy applies in relation to our goods and services.

Website Hosting
You can cancel your website hosting plan with us at any time. If you wish to cancel your hosting, you must notify us in writing of this. Our fee for cancellation is 2 month hosting fee based on your current plan. Customers that have paid for website hosting in advance will be refunded a pro rata return of the amount they have paid in advance LESS the cancellation fee. We reserve the right to suspend and/or cancel your hosting plan without prior notification at any time due to the non payment of your hosting account.

Website Design
We generally require you to pay a deposit prior to Aykira commencing work on your website design. We may also offer you and agree to accept a payment instalment plan during the course of designing your website. Once we have commenced the work, Aykira reserves its right to retain this deposit including any and all instalment payments in full should you subsequently choose not to proceed with your website design, not have Aykira complete your website design, not pay for any outstanding instalments agreed to under an instalment payment plan or not pay the total amount in full for your website design. Aykira reserves its right to retain all payments relating to the work it has completed during the design process whether or not the total website design is completed or delivered. If you advise us not to proceed and we receive this advice prior to commencing work, Aykira will refund in full your deposit paid to us. Other conditions for refunds may apply to web site design services we provide. If applicable, these will appear in your contract and/or service conditions you will have signed. Please refer to your contract for full details.

Search Engine Promotion, Marketing
Search Engine Promotion (SEP) and Marketing agreements are generally either 3 month agreements and run for the respective period. Aykira generally charge for SEP and Marketing on a monthly basis. The minimum term of a SEP or Marketing agreement is 3 months. By signing a SEP or Marketing agreement, you agree to pay to Aykira the costs set out in the agreement and Aykira agree to provide the services as set out. You can cancel a SEP or Marketing agreement after expiration of the minimum term, subject to 30 days notice in writing. If you do, a cancellation fee of 2 months SEP or Marketing fee will apply. Prior to expiration of the minimum term, you are liable for the monthly costs for the 3 month period. Should you cancel the agreement prior to expiration of the minimum term, no refund will be available for charges relating to this period. Should you cancel your SEP or Marketing after the minimum term has expired, customers that have paid for SEP or Marketing in advance will be refunded a pro rata return of the amount paid LESS the cancellation fee.

Licensed Computer Software
Aykira’s software it provides is Licensed – not sold. Should you wish to discontinue using any Licensed software you have purchased from us, in the absence of any specific, limited refunds statement contained in a License Agreement specifically relating to the particular product you have purchased, generally, neither Aykira, its Agents nor Authorised Representatives offer refunds on any Licensed software you have paid us for. Aykira reserve its right to retain the full Installation, Setup & License Fee or other fees you may have paid relating to the Licensed copy of software we have provided to you. Please satisfy yourself the software is suitable for your needs before paying for it. Aykira will not be liable to any person or organisation under any circumstances for any indirect, consequential, incidental or special damages arising in any way out of your use of our Licensed software including its performance and/or non performance. Where Aykira cannot exclude liability, to the extent permitted by law, our liability will be limited to re-supply of the relevant Licensed software or equivalent software, the cost of re-supplying the software, or equivalent software, at our option.

Graphic Design, Design Concepts, CD/DVD & Film
Aykira generally require customers to approve and agree in writing their acceptance of finished art and products including graphic and logo designs, advertising layouts, design concepts, CD/DVD presentations, film productions, photography and other media services, prior to supplying and delivering this to you. Under these circumstances, Aykira offer no refunds for completed work or services we have provided.
